Terms of Service

1. Acceptance of Terms

By accessing or using Muafay Marketplace, owned and operated by Muafay Ventures ("Muafay", "we", "us", or "our") at muafay.ug, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

2. Who Can Use Muafay

  • You must be at least 18 years old to register as a vendor.
  • You must have a valid Ugandan phone number or email address.
  • Businesses must be legally registered or operating in Uganda.
  • You are responsible for all activity on your account.

3. Vendor Accounts

  • Vendors must provide accurate business information during registration.
  • Vendor profiles are subject to review and approval by Muafay.
  • Muafay reserves the right to suspend or reject any vendor account that violates these terms or misrepresents their business.
  • Each business may maintain one active vendor account.

4. Subscriptions and Payments

  • Vendor listings require an active paid subscription (monthly or annual).
  • Payments are processed via our licensed payment partners supporting MTN MoMo and Airtel Money.
  • Subscriptions are non-refundable once activated.
  • Listings are suspended automatically if a subscription expires and is not renewed within the grace period.
  • Muafay reserves the right to change subscription pricing with 30 days notice.

5. Prohibited Content

Vendors may not list or promote:

  • Counterfeit, illegal, or stolen goods.
  • Weapons, drugs, or controlled substances.
  • Adult or sexually explicit content.
  • Products or services that violate Ugandan law.
  • Misleading or fraudulent listings.

6. Buyer Interactions

  • Transactions between buyers and vendors are conducted directly — Muafay is not a party to these transactions.
  • Muafay does not guarantee the quality, safety, or legality of listed products or services.
  • Disputes between buyers and vendors must be resolved between the parties directly.

7. Reviews

  • Buyers may leave honest reviews of vendors they have interacted with.
  • Vendors may not solicit fake reviews or offer incentives for positive reviews.
  • Muafay reserves the right to remove reviews that violate these terms.

8. WhatsApp Communications

By registering with a WhatsApp number, you consent to receive transactional WhatsApp messages from Muafay including account updates, subscription alerts, and review notifications. You may opt out by contacting hello@muafay.ug.

9. Intellectual Property

  • The Muafay name, logo, and platform design are owned by Muafay Ventures.
  • Vendors retain ownership of their business content (images, descriptions) but grant Muafay a licence to display it on the platform.
  • You may not copy, reproduce, or distribute any part of the platform without written permission.

10. Limitation of Liability

Muafay is provided "as is". To the maximum extent permitted by Ugandan law, Muafay is not liable for any indirect, incidental, or consequential damages arising from use of the platform, including losses from vendor transactions or service interruptions.

11. Termination

Muafay may suspend or terminate your account at any time for violation of these terms, fraudulent activity, or conduct that harms other users or the platform. You may close your account at any time by contacting us.

12. Governing Law

These terms are governed by the laws of the Republic of Uganda. Any disputes shall be subject to the jurisdiction of the courts of Uganda.

13. Changes to These Terms

We may update these terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated terms. Significant changes will be communicated via WhatsApp or email.
